Upon Payment of the sum of $ _____________ (purchase price) paid by buyer to seller, receipt of which is hereby acknowledged, Seller grants and sells transfer of ownership of the following dog to buyer.

Both parties agree to be bound by the following terms and conditions governing the purchase and sale of this dog:
Deposit, Payment, and Purchase Price
Buyer has paid a deposit of $_________ cash or PayPal w/ 3.5% fee) with payment of the balance of $_________due upon release of this dog to buyer. The mutually agreed upon delivery / pick up date is ________________. If transport ‘via pet nanny or other agreed upon service is required, payment in full is due 10 days prior to transport. Payment of the balance may be made by cash or money order.
Buyer acknowledges and agrees that the buyer will forfeit the deposit and any rights to the dog if:
Buyer fails to complete the purchase of this dog for any reason, or
Buyer fails to pay the balance of the purchase price 10 days prior to transport or 3 days after 8 week vet exam, whichever is last. At which time seller has the right to offer this dog up for sale to another family.
In the event that the dog is not available due to sickness, death, quality, or any other circumstance due to the fault of the seller, buyers deposit will be, at buyers option, either be refunded, or transferred to another puppy should one be available.
Transfer of Ownership and AKC Registration
Upon Payment in full of the Purchase Price, Seller shall promptly take all actions required to officially transfer Ownership and AKC limited registration of this dog to buyer as agreed.
Sellers representation and warranties to Buyer:
Seller is the true and legal owner of the dog
This dog is the breed and true off spring of the sire and dam referenced on page 1 of this agreement
This dog is in good health and free of communicable diseases at the time of this sale as shown by a current health certificate and provided to buyer with this dog.
d) Seller gives Buyer 3 business days from the delivery date to have the Dog examined by a licensed veterinarian, at Buyer's sole cost. If the Dog fails the examination, Buyer may return the Dog(at buyers expense) with a written statement from the veterinarian - after confirmation from our veterinarian a replacement puppy of equal quality will be provided when one becomes available. Failure to have the dog examined within 3 business days will nullify this warranty. Should buyer wish to keep the dog, no replacement will be given, and medical cost and treatments are the sole responsibility of the buyer. Buyer releases and holds harmless Seller from any liability resulting from any and all health issues and medical costs.
e) Return / Refund: Seller retains the right of first refusal. Should buyer not want to keep the dog seller will accept the dog back upon pre approval and except for health guarantee (see f) If the dog is young (4 months or less)and is in a healthy condition and sound mind to be resold, buyer will receive 75% whatever the new purchase price (set and received by Seller) minus any and all expenses Seller occurs during this time. This refund will be issued to buyer only after new sale is complete. Should Seller receive the dog back, Buyer will provide the Seller with any and all documentation for the dog, including medical records and registration papers and transfer form for microchip.
f) Health Guarantee:
Seller guarantees this puppy for 2 years from date of birth for any genetic disorder that would significantly shorten the life span of this dog - attested to in writing by buyers veterinarian / canine specialist to seller and / or sellers choice of 2nd opinion veterinarian report dated within 2 days of diagnosis. This must be a life threatening or life altering genetic disorder that will shorten the life span or cause life time health issues that lessen dogs quality of life and ability to have a normal life. In this event the dog can be returned to seller at buyers expense and a replacement puppy of equal quality will be provided when one becomes available. We are not responsible for injuries or hypoglycemia(brought on by stress or lack of eating) or coccidia / giradia once in buyers care or flea / tick related problems once in buyers care.
g) Seller does not guarantee Dog against any health related problems or death caused from vaccines, heart worm prevention, or flea/tick treatments (oral or topical). This includes symptoms of kennel cough after dog has received the vaccine. Seller does not guarantee injuries resulting in loose patellas or cherry eyes. If Dog did not have these issues at time of purchase, Seller is not responsible for them.
** Note on vaccines: Bordetella and a 5 way puppy vaccine can be given on the same visit. Leptospirosis should not be given in combination with any other vaccine or any sooner than 16 weeks of age if necessary for your area. A vaccine containing corona should not be given any sooner than 20 weeks of age, and only if necessary for your local region. Rabies vaccine and the last puppy shot can not be given at the same time. ** Please titer test your dog prior to 1 year boosters.**
**Note on Havanese teeth: The teeth will erupt later than other breeds depending on bloodlines - be patient! Your puppy will have teeth.
Buyers Representations to Seller:
(A) Buyer will maintain the dog in good health, including routine veterinary care to include: keeping up with parasites, internal and external, dental care: keeping teeth clean and extractions of puppy teeth, keeping up heart worm prevention and rabies vaccine per law.
(B) This Dog will reside inside the home of the Buyer and his/her family. Dog will not be allowed to roam free outside at will and will not be permanently chained or tethered outside. Dog will be kept free of gross matting and not allowed to sit in his/her feces/urine for long hours.
(C) Buyer will provide the Dog with nutritious high quality food and daily vitamins. NuVet Plus highly recommend : 1-800-474-7044, using order code 22844 or online at www.nuvet.com/22844.
(D)Buyer will keep Dog coat groomed and free of matts and debris.
(E) Buyer will seek proper training to ensure the temperament of the Dog is fit for his/her family. Behavior issues are the responsibility of the buyer to correct and train. Seller recommends “Doggy Dan online videos”
(F) Buyer will NOT breed this dog to any dog of any breed. Dog is to be spayed/neutered. Males: recommend neuter at 9-12 months. Females between 7-15 months (3 months after the first heat cycle). Seller may seek recourse in court of up to $5000 for Dog being bred as well as repossess this Dog.
Indemnity and Release
Buyer releases Seller from any and all liability, costs or damages caused by the Dog after placement with Buyer, including but not limited to damage to or destruction of property, and injury to any person.
Governing Law
This agreement shall be governed by and construed in accordance with the laws of Missouri.
Entire Agreement
This agreement represents the entire agreement between the parties. Seller and Buyer have made no other agreements, promises, representations, or warranties, express or implied, unless specifically stated in this agreement. Seller and Buyer further intend that this agreement be fully binding between parties and agree to be held to the terms of this agreement.
The undersigned agree to uphold all covenants of this agreement in its entirety
